SAMPHIRE SAUNA TERMS AND CONDITIONS OF USE

In these Terms and Conditions “the Company” means Samphire Studios Limited T/A Samphire Sauna and “the Client” means the person named as the client in the booking.

Any person hiring the sauna for either long or short term use are subject to the following Terms and Conditions.
The company reserve the right to refuse any booking at their discretion. 

All binding contracts entered into between the company and the client shall be governed by English law and be under the exclusive jurisdiction of the courts in England and Wales. 

All prices quoted are in pounds sterling unless otherwise stated. 

Booking and Cancellations policy of Samphire Sauna

  • When booking to use the sauna at one it’s fixed bases for short term use (eg: from one to several hours but no more than a day) the client booking will include 10 mins at the start and 10 mins at the end of the session for changing (ie. for an hour’s booking you would have 40mins sauna time).

  • If the client is late for the booking, they will still be required to end the sauna session at the end of the original booked time. 

  • The company will supply all the wood you will need for the duration of the hire period.

  • Upon booking the client will be required to read and sign the company disclaimer, after which a trained operative will show the client how to correctly and safely use the Sauna. If the company become aware that the Sauna is being used in an unsafe or otherwise incorrect manner, they reserve the right to terminate the client’s sauna session immediately and halt usage of the Sauna. 

  • No refunds will be given if the hire agreement is terminated by Samphire Sauna for unsafe or improper use, if the sauna is rendered otherwise unusable, we will seek to recover any damages via legal recourse.

  • The full fee for the sauna session is taken at the time of booking. We offer a full refund or full credit to rebook your session if cancelled up to 5 days before your booking.

  • If you need to cancel within 5 days of your booking we can offer full credit to rebook but no refund. 

  • The client shall indemnify the company against any claims made against it as a result of negligence or wilful default by the client or their guests. 

  • The company reserves the right to make a charge for any loss or breakage of equipment, furniture, fixtures and fittings, which it reasonably regards as being exceptional.

  • Alterations by the company: The Company cannot be held responsible for delays or failure to complete the contract owing to exceptional circumstances known as a “force majeure”. If the company, as a consequence of a “force majeure”, is obliged to curtail, alter, extend or cancel a booking the client shall not be at liberty to maintain a claim for compensation or otherwise for any loss arising as a consequence of the said curtailment, alteration, extension or cancellation of the booking. 

  • Where the company makes an alteration in the booking as contemplated, no compensation shall be payable where the alteration is for the reasons outside the direct control of the company. 

  • In these terms & conditions the term “force majeure” means an Act of God, natural disasters, adverse weather conditions, fire or other destruction of any vessel, craft, property or vehicle to be used in connection with the function, riots, acts of war, terrorism, epidemics, pandemics or diseases, civil commotion, exercise of legislative, municipal, military, or other authority, strikes, industrial action, requisition of equipment, mechanical breakdown, insolvency or default of any carrier or service connected with the function, fraud perpetrated against the company or any other reason beyond the control of the company and act or thing outside the control of the party affected.

Appendix 

Health & Wellbeing 

We feel that you are the best person to manage your own health, and suggest that before use of the Sauna you consult your GP or another medical professional should you have any concerns at all. We will provide instructions for safe use of our Sauna; we will not be held liable for any accidents occurring as a result of improper or unsafe use of the Sauna. We will also not be held liable for any accidents or emergencies that occur during safe and normal use of the sauna, your health and wellbeing is considered your own responsibility and you use the sauna at your own risk. We strongly recommend you do not use glass drinking vessels in the Sauna and we will not be liable for any injuries caused by glass breakages in or around the Sauna. 

Alcohol and Drugs 

We strongly recommend you do not use the Sauna after the consumption of alcohol or other mindaltering substances as these can interfere with your body’s ability to regulate temperature and cause injury; this is the hirer’s responsibility and we will not be held liable for any accidents or damages as a result of intoxication. 

Children 

No children under the age of 7 years old are allowed to use the sauna. An adult guardian must accompany all minors (up to the age of 16) on a 1:1 ratio. 

Smoking

You may not smoke or use E-Cigarettes inside the Sauna 

Security 

You may leave your belongings in the changing room, an attendant will be around at all times, but items are left at your own risk and we will not be held liable for any items lost or stolen. 

Complaints

If the client wishes to make a complaint in relation to the hire they must: 

  • Immediately inform a representative from the company at the location where the hire is held and the compliant arises. The client shall, if the company requires, complete a form setting out the detail of the complaint. If the client fails to comply with such requirements, the company shall be entitled to recover the cost from the client of any additional expense incurred by carrying out investigation of a complaint, which is found to be unjustified. 

  • The client shall be obliged to notify the company in writing of any complaint no later than 14 days after termination of the hire period
